South Florida Firm Files First Claim for Damages Caused by Defective Stryker Hip Implants - Searcy Denney Scarola Barnhart & Shipley PA Seeks Damages Caused by Recalled Product

South Florida law firm Searcy Denney Scarola Barnhart & Shipley PA (Searcy Denney) announced today that it has filed the first lawsuit claiming damages caused by the company's defective Rejuvenate and ADM hip implant systems.

2012-08-10
WEST PALM BEACH, FL, August 10, 2012 (Press-News.org) South Florida law firm Searcy Denney Scarola Barnhart & Shipley PA (Searcy Denney) announced today that it has filed the first lawsuit against Howmedica Osteonics Corporation, dba Stryker Orthopaedics, claiming damages caused by the company's defective Rejuvenate and ADM hip implant systems.

The suit was filed in Bergen County, New Jersey Superior Court, by Searcy Denney, joined by The DiCello Law Firm and Weitz & Luxenberg, on behalf of plaintiffs Dianne and Phillip Pingel. The husband-and-wife plaintiffs claim that the defendant failed to use reasonable and due care for the safety and well-being of patients in the development, testing, marketing, packaging, and selling of the defective product.

On July 4, 2012, Stryker posted a national recall of the Rejuvenate and ADM hip implant systems apparently after receiving multiple reports of the premature failure of those systems. "That recall is tantamount to an unequivocal admission by the defendant as to the dangers and defects of their product," said Cal Warriner, a shareholder at Searcy Denney, who represents Mr. and Mrs. Pingel. "Stryker must now redress the damages that these defective systems have caused."

The lawsuit seeks compensatory and punitive damages to cover the medical, hospital, rehabilitation, and pharmaceutical costs incurred by the plaintiffs as a direct result of the implant failures.

"Currently there are more than 60 adverse event reports filed with the FDA's MAUDE incident reporting system," Warriner added. "The Rejuvenate device has been on the market since 2009 and the number of incidents has been climbing exponentially since the beginning of 2012.

"These devices are supposed to last 15 to 20 years. When they fail in huge numbers in less than two years post-implant, there is a serious problem."

Dianne Pingel received the implant on October 24, 2011 and began experiencing significant immediate discomfort. She then suffered heavy metal ion contamination from fretting and corrosion issues, pseudotumor formation, necrosis, and adverse soft tissue reaction. She currently faces eight weeks of inpatient rehabilitation.

Stryker hip implants have been a particular source of controversy since April 2012 when Howmedica Osteonics issued an Urgent Field Safety Notice to surgeons and hospitals that cited failures at the taper neck junction causing corrosion and fretting. The defendant had previously claimed that these problems would not occur due to the new design of the system.

The plaintiffs have requested a jury trial.

This month's post focuses on the most effective marketing techniques for small businesses. Lacking the budget of larger companies and corporations, small- and medium-sized businesses (SMBs) may feel that they are at a disadvantage when it comes to marketing. While it is true that SMBs cannot afford the brand promotion and advertising of larger companies, this does not mean that they cannot market effectively. SMBs need to think outside of the box and come up with unusual and creative methods. Anything that increases exposure will help drive traffic to your site or people ...

Genomic study of rare children's cancer yields possible prognostic tool

2012-08-09
SALT LAKE CITY—A new study of the genetic makeup, or genome, of Ewing sarcoma, a rare cancer that strikes children, teenagers, and young adults, has produced multiple discoveries: a previously unknown sarcoma subtype, genetic factors related to long-term survival, and identification of a genetic change between the primary and metastatic stages of the disease that could lead to better, more targeted treatment. Researchers from Huntsman Cancer Institute (HCI) at the University of Utah used a new, advanced technology called molecular inversion probes (MIPs) to analyze ...

NIST focuses on testing standards to support lab on a chip commercialization

Lab on a chip (LOC) devices—microchip-size systems that can prepare and analyze tiny fluid samples with volumes ranging from a few microliters (millionth of a liter) to sub-nanoliters (less than a billionth of a liter)—are envisioned to one day revolutionize how laboratory tasks such as diagnosing diseases and investigating forensic evidence are performed. However, a recent paper* from the National Institute of Standards and Technology (NIST) argues that before LOC technology can be fully commercialized, testing standards need to be developed and implemented. "A testing ...

Depression linked with increased risk of peripheral artery disease
2012-08-09
Depression was linked with an increased risk of peripheral artery disease (PAD) in a study of more than one thousand men and women with heart disease conducted by researchers at the San Francisco VA Medical Center and the University of California, San Francisco. PAD is a circulatory problem in which narrowed arteries reduce blood flow to the limbs – usually the legs and feet – resulting in pain, reduced mobility and, in extreme cases, gangrene and amputation. The study was published electronically on July 26, 2012, in the Journal of the American Heart Association. Marlene ...

Scientists use worms to unearth cancer drug targets

BETHESDA, MD – August 9, 2012 -- Through novel experiments involving small nematode worms, scientists from Wyoming have discovered several genes that may be potential targets for drug development in the ongoing war against cancer. Specifically, researchers hypothesize that inhibiting these genes could reverse certain key traits associated with cancer cells. This discovery is published in the August 2012 issue of the Genetics Society of America's journal GENETICS (www.genetics.org). "Cancer is a leading cause of death worldwide," said David S. Fay, Ph.D., a researcher ...
