On June 7, 2012, the New Jersey Assembly Law and Public Safety Committee approved a bill that would increase the possible penalties for those who have multiple driving under the influence convictions. Drivers in New Jersey should be aware of the state's punishments for repeat DUI convictions and how they may change if the Assembly passes this bill.

Current DUI Penalties

The punishment for multiple DUI offenses in New Jersey is already severe:
-Second DUI conviction: forty-eight hours to 90 days in jail, 30 days of community service, up to $4,655 in fines and fees, a two-year license suspension, and required ignition interlock use during the license suspension and for up to three years following license restoration
-Third DUI conviction: up to 180 days in jail, 90 days of community service, up to $6,155 in fines and fees, a ten-year license suspension and required ignition interlock use during the license suspension and for up to three years following license restoration

Proposed Changes

The bill would change the law so that if a driver receives a second DUI conviction within 60 days of the first one, it would be a fourth-degree offense. The driver would face up to 18 months in prison and a $10,000 fine if convicted. The bill would also give judges the authority to impose bail up to $10,000 for such offenses. Under current law judges usually cannot order bail in excess of $2,500 for fourth-degree offenses.

The bill would also require police departments to record DUI charges within three hours of the charges being filed.
