Surrogacy Arrangements - Five Tips to Protect Yourself

1. Do your homework: If you are working with a physician, attorney, agency or psychologist, go to their office and meet them and their staff. Ask questions about success rates, how long have they been in business, do they have any insurance and what type of insurance do they carry, do they have any patient or clients that are willing to give a reference for them?

2. Beware of surrogacy agencies, clinics or law offices that claim that they work with high profile clients and celebrities. Remember, if that were really the case, you would not know about it.

3. Where are they asking you to send your money? If the money is not being held in a bonded and licensed escrow company or an actual Attorney-Client Trust Account, how is your money being protected? Ask questions and ask for proof.

4. Everything is negotiable, if there is something in the retainer that does not work for your situation, ask for revisions. If they won't make any change or at least compromise, ask them why and be weary of the standard response that we just don't change our retainer.

5. Finally, use your head and use your gut before agreeing to anything. If they are rushing you to sign and pay, you may want to take a breather and make a list of pros and cons to look at them objectively before you sign a retainer or service agreement.
