A DUI conviction comes with severe consequences including fines, license revocation and jail time. A 36-year-old Nevada man was recently arrested on several charges, including driving under the influence, after his car allegedly collided with two other vehicles.Police claim man left the scene and was located nearby
The Las Vegas Sun reports that the man's vehicle struck two other vehicles in separate incidents, killing a passenger in the second vehicle. Henderson Police contend that the man then tried to walk away from the scene of the second accident.
After crashing into the back of one vehicle, the man reportedly continued driving and then hit another vehicle head-on. The man was apparently seen walking away from his vehicle after the crash and was eventually located near the accident scene. The driver and another passenger in the second vehicle were transported to a local hospital and treated for injuries.
Along with a DUI, the man is officially charged with leaving the scene of an accident, as well as a hit and run. He is currently being held in a local jail without bail. At this time, the events are reported from the police statement and the accused man has not had the opportunity to answer to the charges. A person convicted of a DUI could face several consequences depending upon the circumstances.
A DUI conviction results in severe penalties
Nevada DUI law defines driving under the influence of alcohol as "illegal per se." This means that an individual found to be driving a vehicle with a blood alcohol level at or above the legal limit is automatically presumed to be driving while impaired.
However, the legal limits are only recommendations, and an individual may face a DUI arrest even if he or she is under the legal limit or under the influence of a forbidden controlled substance.
An individual stopped on suspicion of a DUI must submit to testing. Testing usually involves a breath or blood test. If an individual refuses a test, current law allows police officers to use reasonable force when attempting to obtain a blood sample.
Those convicted of DUI face serious penalties, even for a first offense. Information from the Nevada Department of Motor Vehicles states that penalties for a typical first DUI offense include the following:
Substantial fines and fees
Between two days and six months in jail
License revocation of 90 days
Fines for a first DUI offense range from $400 to $1,000. Additional fees are usually also imposed. For instance, a chemical test fee of $60 is usually required.
There are also fees involved with reinstating a driver's license. Driver's license reinstatement is not guaranteed. An individual must meet all reinstatement requirements, pay all appropriate fees, and reapply for a license to successfully reinstate a driver's license. These requirements must be met even if the actual DUI charge is reduced or eliminated.
Penalties increase with subsequent DUI convictions. An individual who is convicted of three DUIs within seven years faces felony charges.
An individual facing a DUI charge should consult with an experienced DUI attorney. A qualified attorney can investigate all evidence and help mitigate the negative consequences of a DUI charge.
