Mr. O'Malley was able to establish that the muddy conditions that existed could have been fixed by the general contractor, William A. Randolph, Inc. Mr. O'Malley argued that the general contractor could have added stone, dewatered, demucked, or graded the ground conditions to provide a safe place for people to work. Faced with a rapidly approaching trial date, the general contractor, William A. Randolph relented and agreed to pay Mr. Walter Kapusciarz $2,250,000.00.
