March 14, 2014 (Press-News.org) Winter is the favorite time of the year for many people who live and visit Utah. Utah is a very popular destination for skiers and snowboarders, with several different resorts areas located across the state. With residents and tourists filling the resorts during the winter months, and thus with so many people on the slopes, it is not uncommon for there to be accidents.
Resorts can be extremely dangerous places. They will often be filled with skiers and snow boarders who may not have enough experience for the conditions, which can increase the risk of accident. Skiers could fall from lifts taking them to the top of the mountains, or they may be injured by equipment being used to maintain the slopes.
While resorts may spend a significant amount of time trying to ensure the safety of their guests, there is no guarantee that they will be able to completely minimize the dangers. The owners and operators of these facilities may try to blame the "inherent risks" of skiing for the accident. However this legal doctrine is limited to conditions that are expected or wanted by skiers. For example a skier cannot bring a claim because the runs are too steep or too icy. Other non-natural conditions are not covered by this limitation on liability.
Collisions between skiers and/or snowboarders can result in injuries. In such a situation the uphill skier usually is responsible as they can best prevent the accident.
