New Texas Board Certification Available in Criminal Appellate Law

The accused saw an advance in their ability to receive more seasoned representation due to a new Texas Board of Legal Specialization program to certify criminal specialists in criminal appellate law.

Broden & Mickelsen recently entered a blog post on their website, http://www.brodenmickelsen.com/blog/ about a new Texas Board of Legal Specialization program to certify criminal specialists in criminal appellate law.

Though Broden & Mickelsen are not certified, they are happy with the additional certification program and the value it creates to help the accused in Appellate Courts.

Applicants must demonstrate substantial involvement and special competence in criminal appellate law practice by providing such information as may be required by the Texas Board of Legal Specialization.

There are certification requirements. An applicant must have devoted a minimum of 25% of his or her time practicing criminal appellate law during each year of the 3 years immediately preceding application.

There are task requirements. Applicants must have performed a minimum of 50 relevant tasks as lead appellate counsel. The nature, complexity and duration of these tasks will be taken under consideration. In addition, 5 oral arguments at an Appeals Court must have been performed, 25 of which shall have been in the 3 years prior to application.

There are reference requirements. These reference requirements include having tried a criminal appellate law matter with or against 4 attorneys heavily involved in criminal appellate law as well as one judge who the attorney has appeared before advocating a criminal appellate law matter.

Though not certified, this gives Broden Mickelsen the opportunity to highlight their success in federal appeals.

To date, Clint Broden has handled approximately 70 federal appeals. He has been successful in receiving oral argument in approximately 50% of cases. This is considerably above the average of 10% of criminal cases in the 5th circuit achieve an oral argument. In addition, he has been successful in obtaining relief in about 25% of cases he's handled. The 5th circuit only grants relief in about 8% of cases.
