Uncertainty Over Marital Home as Asset During Tough Economic Times
The Great Recession and the housing crisis may have rewritten the rules on whether the marital home should be viewed as an asset -- at least temporarily. People going through divorce in Pennsylvania like other places in the country hit by the housing crisis have to decide whether their former marital home is an asset or a liability.
In some cases, one former spouse may decide that the house is an asset, but may not be ready to take on the financial responsibilities of the house on one income. Even ...

According to statistics from the Centers for Disease Control and Prevention, violent acts are attributed to approximately 51,000 deaths each year. In cases of domestic violence -- sometimes referred to as intimate partner violence -- children, women and men can all be victims. With the news full of these stories, Tennessee's state legislature is considering several bills to tackle what it sees as a growing problem.
Both the Tennessee House and Senate have offered a number of bills that specifically address the issue of domestic ...

New Social Security Disability Rules: One Claim at a Time
Citing "an increase in the number of subsequent disability claims in recent years," the Social Security Administration (SSA) has changed the rules for filing more than one disability claim at a time.
Previously, a claimant was allowed to submit a new disability claim while a prior claim was pending. Under Social Security Ruling 11-1p, people seeking disability will no longer be allowed to have two claims for the same type of benefit pending at the same time. A new claim under a different type of benefit ...

Legislation Targeting DUI Checkpoints
If you have ever been stopped at a DUI checkpoint, you may be left wondering just how effective they are at catching actual drunk drivers. You may also have contemplated whether these checkpoints are designed more to increase revenue from impoundment fees rather than find actual drunk drivers. If you have had these thoughts, you are not alone.
Democratic state Assemblyman Michael Allen of Santa Rosa has proposed legislation that would require checkpoints to be only on those roads with high rates of drunk driving arrests. The proposed ...

North Carolina Bike Laws
According to the National Highway Traffic Safety Administration (NHTSA), 51,000 pedal cyclists were injured and another 639 were killed on our nation's roadways in 2009. In North Carolina, 16 cyclists died on state roads out of the 1,314 total traffic fatalities across the state. While these numbers represent barely 1 percent of all highway-related human losses, these deaths were needless and preventable.
While North Carolina does not rank as the most dangerous state for bicyclists -- Florida has that distinction -- it has not earned the reputation ...

Ways to Avoid the Time and Expense of a California Probate Proceeding
Most people know that if they obtain a will their assets will be distributed according to their final wishes.
But the process of asking a court to actually make the distribution -- called probate -- can be lengthy and expensive. It's also a public proceeding in most states, so privacy concerns do exist for many. Probate starts when the executor of the estate, who is named in the will, files a petition to the Superior Court (in California) to be officially named by the court. Along with the petition ...
