November 25, 2011 (Press-News.org) Baby Boomers Currently Divorcing More Than Any Other Age Group
Once a marriage has survived for 20 years -- through all its difficulties, after raising children and building a career -- one would think the marriage could survive anything. Yet baby boomers are increasingly getting divorced, even if the marriage has lasted 20 years or more.
A study by the National Center for Family & Marriage Research at Bowling Green State University found the rate of divorce for people over 50 has doubled. Also, according to recent data from the U.S. Census Bureau, a quarter of all current divorces are for marriages that lasted longer than 20 years.
What accounts for the rise in divorce for this generation? Life changes for those about to enter their golden years can prompt a re-evaluation of their marriages. Without children in the house and extensive demands on their time, baby boomer couples are realizing that they haven't worked on their marriages in a long time. A lack of communication between spouses or even a midlife crisis can contribute to the breakup of a marriage.
In addition, men and women who previously would have been reluctant to file for divorce because of social or religious stigma have fewer restrictions in pursuing divorce.
Another potential reason for "gray divorce" is that each spouse is more likely to be self-supporting and financially secure. Unlike some in the wake of the Great Recession, baby boomers may have the financial assets that result from a lifetime of work. Many baby boomers do not need to stay together just to get by on a day-to-day basis.
The Divorce Process for Baby Boomers
In some cases divorce can be less contentious for those in their 50s and 60s. A desire for mutual attendance at family events, promoting the well-being of the family, as well as wanting to simply move on, can all make the process smoother. Mediationmay be an option for a divorcing couple wishing to split amicably. If there are traditional divorce proceedings, baby boomers may be able to look sensibly at finances to decide the best choices for moving forward.
Filing for divorce is a significant decision. Consult a family law attorney if you are considering a divorce to determine your options and discuss your situation.

How do you help in such a case? It's important to avoid putting an elderly person on the defensive. "Elder Care Made Easier" author Marion Somers advises ...

Tips for Avoiding Wage Garnishment During Debt Collection Proceedings
According to CNN, the average American household with at least one credit card has $10,700 in credit-card debt. In addition to owing money on credit-cars, many people also owe money on their homes, cars and for higher education.
It is unfortunate that many individuals and families are burdened by debt collection lawsuits, constant phone calls or wage garnishment. Considering the job market and the overall state of the economy, it is no wonder why Americans are struggling to pay off their debt and ...

Property Division Even Tougher When A Family Business Is Involved
Apart from child custody, property division is often one of the most contentious aspects of a divorce case. When the property in question is a family business, the situation gets even stickier.
Just like homes, cars and investments, family businesses are, in most circumstances, marital property that is subject to division during a divorce.
This is true even if the business was a sole proprietorship or if only one spouse was involved in running it. The law generally assumes that the other spouse contributed ...

CA High Court Indirectly Affirms Workers' Compensation Claim Flexibility
Workers' compensation is designed to protect both employers and employees from unexpected costs arising from a work related injury or illness. Although not all workers are covered, including contractors, workers' compensation provides people with funding, as well as peace of mind when they are unable to work.
Here is an example of how workers' compensation functions: if an assistant is putting away heavy filing boxes, but slips and severely injures her back, workers' compensation insurance should ...

Contributory Negligence in North Carolina
In relationships, fault is a matter of perspective, but in the legal arena, fault determines degrees of liability and the right to fair compensation. In most states, comparative negligence rules apply. In North Carolina and only a few sister states, contributory negligence is the standard. While attempts have failed in the past, the state's lawmakers have drafted a bill to abandon this old standard.
Generally, contributory negligence is a common law rule that bars accident victims from receiving fair compensation for injuries ...
