Summer in Colorado is known for camping trips, Rockies baseball and intense heat waves. It is also a time when law enforcement agencies increase drunk driving patrols. Like the summer of 2011, the state's "100 Days of Heat" campaign is in effect this year. A take on the "100 Deadliest Days of Summer" safety campaign by the American Automobile Association (AAA), 100 Days of Heat is a federally funded program aimed at keeping Colorado roads safe from drunk drivers.

A number of fatal accidents occur between Memorial Day and Labor Day. According to a AAA study of 2010 crash data, seven of the top ten deadliest driving days occur during this time (June 10, July 4th, July 9, August 8, and August 14). Out of 13 traffic fatalities in Colorado last summer, six involved alcohol and one involved drugs. Because of that, law enforcement agencies have a vested interest in making DUI arrests. Last year's drunk driving crackdown resulted in nearly 2000 arrests during the summer.

These ominous statistics emphasize one important fact: getting caught for drunk driving can be a costly lesson. Driving while alcohol impaired (DWAI) is punishable by up to 180 days in jail and a $500 fine. Driving under the influence of alcohol or drugs (DUI) is punishable by up to one year in jail and a $1000 fine. There are administrative penalties to deal with as well, as your driver's license may be suspended for nine months. Drivers must be mindful that these are penalties for first time offenders. The fines and sentences for subsequent drunk driving offenses are much stiffer. In addition to higher fines, second time offenders face mandatory jail sentences.

Nevertheless, being arrested on suspicion of DWAI or DUI is not the same as being convicted of drunk driving. Consulting an experienced criminal defense attorney is an essential part of protecting your legal rights.
