Loss of support, services and prospective inheritance are considered economic losses and often require witness testimony from an economic expert. Loss of society and mental anguish are considered noneconomic losses and do not require expert testimony.
Ohio law also allows surviving family members to recover damages for a victim's conscious pain and suffering before he or she died. Although statutes 2125.01 and 2125.03 are wrongful death statutes and thus do not cover these "survivorship" damages, a victim's family can include a claim for this type of damage in a wrongful death lawsuit.
