On November 9, 2007, the victim was working on a construction project of a new residential high rise apartment building located at 1240 First Avenue (aka 400 E. 67th Street) in New York, NY. While he was working, he was struck by a section of plywood that fell from the floor above him. The plywood fell when another worker was trimming the deck on the floor above. The victim suffered a labral tear in his left shoulder and required two left should arthroscopy surgical procedures.
Keogh Crispi then filed a personal injury lawsuit against the property and the victim was ultimately awarded $1 million for his injuries by the New York County Supreme Court.
