DALLAS, TX, August 31, 2012 (Press-News.org) The upcoming Labor Day holiday weekend, a federal holiday that takes place on the first Monday in September, signals the coming of the end of summer. If you plan on drinking, beware the Texas Department of Public Safety and other law enforcement agencies throughout Texas, which will have more patrols on the streets looking for people suspected of drunk driving through September 5.
Last year at this time law enforcement was on its way to arresting more than 2,000 Texans for drunk driving during the Labor Day holiday enforcement period. This year's enforcement period runs from August 19 through September 5.
If you look up and find the flashing lights of the police behind you, hopefully you've learned what to do if you are stopped. Texas is a state that has pioneered what's called "no-refusal," which means that you might be subjected to a forced blood draw if you refuse the breath test, depending on the circumstances. If you've been taken to the station or to a mobile blood lab, a good rule of thumb is to invoke your right to an attorney right away.
Labor Day Drunk Driving Statistics
Any national holiday can turn out to be one of the worst times to be on the road, in terms of alcohol-related car wrecks, which is why law enforcement agencies boost the number of patrols in the days leading up to a holiday.
According to a Texas DPS news release, 500 of the 2,000 Texans arrested during last year's Labor Day holiday period came about as a direct result of stepped-up enforcement. The goal is to prevent fatal auto wrecks from DWI, which the National Highway Traffic Safety Administration says caused a total of more than 10,000 deaths nationwide in 2010.
Stopped by the Police for Drinking?
This Labor Day holiday will be no different from any other major holiday - if you get pulled over by a Texas police officer, you can face a field sobriety test under Texas implied consent law. The best thing to do is designate a sober driver if you plan on drinking. The second best thing to do, if you are arrested for DWI, is to invoke your right to a lawyer, because the police will do all they can on Labor Day to arrest and test you.
