HOUSTON, TX, September 06, 2012 (Press-News.org) Attorney Benny Agosto Jr., a partner at Abraham, Watkins, Nichols, Sorrels, Agosto & Friend of Houston, Texas, became president of the Hispanic National Bar Association (HNBA) on Sept. 3, 2011. Benny was the first Texas attorney to hold this leadership post, and as the 38th president of the HNBA, he led the organization during the Year of the Advocate.

In the past year, the HNBA has continued to flourish, expanding several of its endorsement and educational programs, as well as continuing to lobby and advocate for laws and programs that will provide low-income individuals with access to legal services.

The growth of the organization's programs includes:
- The Judicial and Executive Endorsement program, which saw Judge Adalberto Jordan being named to the 11th Circuit U.S. Court of Appeals and Mari Carmen Aponte being confirmed as ambassador to El Salvador
- The Legal Education Fund, which held the first-ever scholarship luncheon designed to help increase diversity in the legal profession by funding scholarships for Hispanic law students
- Creation of the Veterans Initiative, a pro bono program focused on helping Latino veterans with legal aid

The HNBA also provided numerous educational opportunities this past year for attorneys, law students and the Hispanic community. These opportunities included:
- The Third Annual Midyear Corporate Counsel Conference in Jersey City, New Jersey, which provided networking and Continuing Legal Education programs for corporate and private practice professionals
- The 17th Annual Uvaldo Herrera National Moot Court Competition for law students
- A careers in law program in conjunction with Jersey City Public Schools
- For the first time, the HNBA awarded over $100,000 in scholarships to students

"It was an absolute honor serving as your HNBA president for an entire year," Benny wrote in a recent letter to the association's members. "The success of the organization would not have come to fruition without the hard work of each one of the HNBA's officers and members. For that, I thank you, and I wish you and the HNBA continued success in your advancing the interests of the Hispanic community. My term is ending, but my love for the organization shall never cease."

Benny Agosto Jr., an attorney since 1995 and board-certified in personal injury trial law by the Texas Board of Legal Specialization, has been active in the HNBA for many years. He is a co-editor-in-chief of the HNBA Journal of Law & Policy, and he has sat on the HNBA Board of Governors since 2006. He also co-founded the organization's Legal Education Fund (LEF). In addition to his work with the HNBA, Benny is a member of the State Bar of Texas and a fellow of the Houston Bar Foundation. He has been named a Texas Super Lawyer (2004-2012), has been selected to be included in The Best Lawyers of America (2012-2013), and has been named one of the Nation's 101 Most Influential Latinos by the Latino Leaders Magazine two years in a row.

Benny Agosto Jr. is a named partner at the Houston law firm of Abraham, Watkins, Nichols, Sorrels, Agosto & Friend. Since 1951, the firm has advocated for the rights of thousands of catastrophically injured clients in cases involving car and truck accidents, work-related injuries, defective products, aviation accidents and other types of personal injury matters.

In many cases, the at-fault driver's employer may be liable for the damages, injuries or death caused by their employee. The scope of liability for employers is broad. Change in the Air: Atlanta Foreclosure Rates Drop in August

2012-09-06
Change in the Air: Atlanta Foreclosure Rates Drop in August Notices Fall to Four-Year Low Many Atlanta area homeowners received encouraging news in August. Notices for home foreclosures dropped from 9,317 in July to 6,426. The reduction is especially nice for homeowners after a May report revealed that Georgia had the highest foreclosure rate in the nation. The new numbers bring Atlanta's foreclosure numbers to the lowest numbers it has seen since 2008. So what is behind the sudden drop in foreclosures? A lawsuit as it turns out. In July, the Georgia Court of Appeals ...

Penn State Scandal May Change State Law, Extend Time to File Charges

2012-09-06
Penn State Scandal May Change State Law, Extend Time to File Charges It is a piece of legislation that is more than six years in the making. The proposal aims to give victims of childhood sexual abuse more time to hold abusers accountable for their actions, allowing an extension on filing deadlines for civil and criminal suits. A bill attempting to reduce the rate of these injuries to children should easily make it through the legislature and be passed, so why the delay? The House Judiciary Committee chairman has been notoriously reluctant to advance bills addressing ...

New Texas DWI Task Force Addresses "Over-Serving" Issue An ongoing effort in Montgomery County, Texas, is trying to cut down on the number of DWI-related deaths. The impetus for the effort was a series of fatal, wrong-way accidents on Montgomery County roads in early July 2012. The DWI task forces, made up of local law enforcement, representatives from the county attorney's office, members of the Texas Department of Public Safety and agents of the Texas Alcoholic Beverage Commission, are trying a new tactic to keep drunk drivers off the road: stop the flow ...

Georgia Restaurateurs Subject of Dram Shop Claim in Federal Court

2012-09-06
Georgia Restaurateurs Subject of Dram Shop Claim in Federal Court The Neighborhood Dining Group operates a series of popular restaurants that feature some of the finest selections Southern dining has to offer. Moreover, what would a good Southern meal be without an accompanying cocktail? However, while one or two aperitifs may enhance the dining experience, things can get out of control quickly when alcohol is over-served to a patron about to drive. This is just what the family of Quentin Miller is alleging in the crash that took his life earlier this year. Victim's ...

2012-09-06
Fifth Circuit Limits Reach of Sex Offender Registration and Notification Act (SORNA) In a somewhat surprising move, the federal Fifth Circuit Court of Appeals recently issued a verdict that has limited the reach authorities have over certain people convicted of federal sex crimes. Background of the Kebodeaux Case The case -- Fifth Circuit No. 08-51185, U.S. vs. Kebodeaux -- involves a Texas resident (and former servicemember) convicted in 1999 of having "carnal knowledge of a child" under Article 120 of the Uniform Code of Military Justice. Kebodeaux ...

Child Custody: Fathers' Rights Then and Now

2012-09-06
Child Custody: Fathers' Rights Then and Now After what appeared to be a long and contentious child custody battle, entertainer Usher Raymond was recently granted primary custody of his two sons with former wife Tameka Foster. While there was a time when mothers had the advantage walking into a child custody dispute, the ruling reflects a shift in child custody law which has leveled the playing field for fathers. From the English-based common law doctrine of paternal rights to the "tender years" doctrine to today, the evolution of child custody laws in the United ...
