BEAUMONT, TX, September 12, 2012 (Press-News.org) Provost represents DBCP clients from five Central American countries--Nicaragua, Honduras, Costa Rica, Panama, and Guatemala. The Dole settlement involves only three of those countries, Nicaragua, Honduras, and Costa Rica; and it terminates litigation against Dole in both Los Angeles Superior Court and the courts of Nicaragua.
The Dole settlement, agreed-to by almost 100% of the Provost clients in those three countries, was specifically examined and approved by a California state court.
"The California state court examined and vetted the Dole settlement for our clients--including the confidential amount paid--and determined it to be in good faith," added Mark Sparks, one of Provost's lawyers.
Provost will continue its DBCP litigation against the remaining defendants, which include Dow, Shell, Occidental, Del Monte, and Chiquita. Notably, of all the law firms actively pursuing DBCP litigation on behalf of Central Americans, Provost is the first firm to achieve a funded settlement from Dole on behalf of its clients.
"We believe this settlement validates our firm's efforts on behalf of DBCP victims and will support the continued litigation against the remaining defendants for as long as necessary to obtain justice for our clients" said Mark Sparks. Funds for the Dole settlement will be available at the disclosed banks for client distribution in a few days.
