Few Traffic Accidents are Investigated in New York City

The New York Police Department seldom investigates motor vehicle accidents. If you have been injured, you will usually need legal help to obtain justice.

2012-10-11
NEW YORK, NY, October 11, 2012 (Press-News.org) The New York City Police Department has become the object of criticism for its failure to investigate traffic accidents. Injured victims are unlikely to obtain answers from law enforcement, whether the accident involved motor vehicles, pedestrians or bicycles. The state of New York recently reported that city police investigated just 2 percent of all nonfatal traffic accidents.

In 2011, there were around 3,000 serious but nonfatal accidents in New York City, according to the state's Department of Motor Vehicles. However, the city's Accident Investigation Squad investigated only 63 of those accidents. In fact, the city's standard operating procedure is to look into crashes only when a victim is likely to die or has died.

Even when a NYC auto accident or other crash results in a fatality, police may be slow to investigate or to take action against a driver who causes an accident. A woman killed at 14th Street and Broadway was hit by a city truck that failed to stop at a red light before making a right turn. The driver never stopped after he hit the young woman who was crossing the street in the crosswalk. Although police later found him, thanks to a video from a nearby bank, the driver was never charged nor issued a citation for violating traffic laws.

Equally disturbing, victims of fatal New York bicycle accidents frequently fail to receive justice. The Canadian parents of a cyclist killed in October 2011 were forced to file a lawsuit so they could see the accident report. Three months after the death of their son, they received the files. They found that the driver received two traffic summonses, but was not charged with any crime. This is apparently typical. Although 241 pedestrians or cyclists were killed by car and truck drivers last year, only 17 faced criminal charges. Even drunk drivers involved in fatal car accidents are charged with DWI rather than something more serious - if they are charged at all.

One reason the police do not investigate car crashes and other traffic accidents is poor staffing; the Accident Investigation Squad has only 20 investigators. The City Council has created a task force to explore procedural changes and the possibility of improved staffing to address the problem.

Given the likelihood that a car collision, bicycle crash or pedestrian accident will not be investigated, New Yorkers should take steps to protect themselves when involved in traffic incidents. If at all possible, they should:

- Stay put. Get information from others involved in the accident. Do not leave until police give you permission to go.
- Don't move injured people or let anyone move you until emergency medical help arrives unless there is danger from traffic, fire or toxic substances.
- Don't admit fault or apologize. There may be facts that you don't know about.
- Notify your insurance company as soon as you can, but do not make a statement before consulting an attorney.
- If you are asked to complete an accident report, be thorough and accurate. Errors could be used against you later.

Following these guidelines can help people involved in New York City motor vehicle accidents preserve their rights. For more information, contact a personal injury attorney.

NYC Traffic Deaths Spike for Motorists, Cyclists and Pedestrians

2012-10-11
The September 2012 Mayor's Management Report revealed a 23 percent increase in New York City traffic fatalities. That number - which includes deaths involving automobiles, bicycles and walkers - is particularly discouraging because it halts a trend of improved safety beginning in 2007. The data measured the period from July 2011 through June 2012, yielding a total of 291 traffic-related deaths. The previous yearlong stretch had only 236 fatalities. The Bloomberg administration is struggling to answer why there was an increase in fatal accidents, suggesting that drunk ...

Scientists Say 'Network Dysfunction' the Most Troubling Impact of TBI

2012-10-11
Traumatic brain injuries are some of the most troubling consequences of motor vehicle crashes and other accidents. It is not just that the side effects of traumatic brain injuries -- which include persistent headaches, sensory impairments, nausea, pain, personality changes and cognitive difficulties -- are so severe. Traumatic brain injuries are also incredibly difficult to diagnose, making it hard for victims to get the medical treatment they need. Still, medical researchers continue to make steady progress in the areas of brain injury diagnosis and treatment. Recently, ...

What Are My Child Custody Rights in Utah?

2012-10-11
Some of the most contentious issues in a couple's divorce relate to child custody and visitation rights. It can be unimaginable for a parent who has spent every day with his or her children to have limits placed on time with their youngsters. Consequently, it is imperative during such trying times for parents to be aware of their rights. When parents cannot reach an agreement, the court will step in to decide custody and visitation rights by considering the best interests of the child. According to the Utah State Courts, some of the factors considered are "the depth, ...

Ohio Child Sex Crime Task Force Rolls Out Mobile Forensics Laboratory

2012-10-11
In any criminal case involving accusations of internet sex crimes, the prosecution must present complex evidence of child exploitation or child solicitation involving computer files, communication records and other data. To counter the impact of this data, a sex crimes defense attorney must understand the technical nature of the evidence as well as a client's rights. The Ohio Internet Crimes Against Children Task Force (ICAC) recently introduced a high-tech mobile forensics laboratory that it will deploy across the state to expedite investigations of alleged child exploitation. ...

Basics of Non-Compete Agreements

2012-10-11
In today's economy, it is common for employees to leave their employers and start their own companies. Whether it is frustration with corporate America or a desire to chase their ultimate dreams, employees who become entrepreneurs can threaten an employer's competitive advantage. This can be especially problematic when former employees compete against their employers, as a number of legal protections that restrict an employer's ability to prevent former employees from competing against them. Essentially, restrictive covenants, generally known as non-compete agreements, ...

Nevada Law Enforcement Cracks Down on Speeding, Distracted Driving

2012-10-11
Speeding and distracted driving are two of the biggest threats to highway safety, both in Nevada and throughout the United States. Engaging in either of these behaviors substantially increases the risk of a serious car accident. Still, many Nevada drivers choose to ignore these dangers in favor of rushing to their destination or texting while driving. Nevada law enforcement agencies have been working hard to combat this problem. This summer, more than 24 state and local departments banded together to launch a "Joining Forces" campaign against speeding and distracted ...

Jumping Through Hoops: New Case Highlights Obstacles for Michigan FTCA Plaintiffs

2012-10-11
Government activities touch much of our everyday lives and those activities can do as much harm as any others. Although it is possible for Michigan private plaintiffs to sue the federal government for some harmful errors, Federal Tort Claims Act cases (FTCA) impose a complicated set of prerequisites. In one recent FTCA decision, a Navy veteran found himself barred from the courts because he did not satisfy those requirements. Glade's Lawsuit Against the VA Sixty-four-year-old Ronald Glade tried to sue a Veterans Affairs hospital after a mental health therapist sexually ...
