However, they can be very useful when the other party appears to be hiding assets or contesting child custody. Although private investigators can be expensive and make divorce more adversarial, they can easily find information that could take ordinary citizens many days to uncover, if at all. Having accurate information about a spouse's activities can be crucial in achieving fairness and protecting children's safety.
Hiding assets
People hire private detectives for a variety of reasons, but one of the most common is to uncover hidden assets. When one spouse suspects that the other has secret bank accounts or has acquired property in his or her name, an investigator can quickly determine whether these suspicions are true. Investigators have access to national databases and records that are not readily available to most people.
Cheating spouses
The private detective and the cheating spouse may be a cliche, but hiring an investigator is probably the best way to determine whether a spouse is cheating. Spouses who have found surprising restaurant receipts or seen unknown numbers on the telephone bill will find that a detective can quickly determine whether their suspicions are true.
Parenting problems
One of the most important things a detective can do is find out whether an ex-spouse is a fit parent. If one parent suspects that the other is exposing children to unsavoury friends, taking drugs or abusing the children, hiring an investigator can be a good way to find the truth or put your mind at ease.
Timing is everything
When you hire the private investigator can be crucial. It is best to hire a detective before you separate or even discuss divorce if you suspect your spouse is cheating. Finding evidence of a cheating spouse after you move out is less powerful in divorce cases.
Don't do your own investigation - it may hurt you later on
People may be tempted to try to record a spouse's phone calls if cheating is suspected. However, wiretapping is illegal in many circumstances. If you suspect your husband or wife is cheating and hope to learn who the other person is by taping phone calls, be sure to consult with a knowledgeable investigator who understands federal and Connecticut law in regard to wiretapping. By acting on your own, you could weaken your position in the divorce.
Investigators have access to technology that can record almost anything. However, cameras and other devices such as software that records keystrokes on a computer may be inadmissible in court. Like wiretapping, using these devices may be governed by state or federal law, so they should be used only when the legal issues are clearly understood.
