In Kansas, people who experience work-related injuries are usually covered by workers' compensation. The Kansas workers' compensation system is designed to provide employees with benefits to cover their medical costs and other financial losses resulting from on-the-job injuries.
Types of Benefits Available
Employees who suffer workplace injuries in Kansas may be eligible for the following types of workers' compensation benefits:
-Medical care for treatment of the injury
-Weekly checks for those who are unable to work while recovering from an injury
-Cash settlements or weekly checks for workers whose injuries leave them permanently unable to work
-Cash settlements or weekly checks for employees who suffer a permanent impairment such as the full or partial loss of use of a body part
In addition, surviving dependent family members of workers who are killed by a work-related injury may be eligible to receive survivor's benefits, including funeral expenses, through the Kansas workers' compensation system.
Submitting a Claim
If you become injured on the job, it is important to tell your employer right away. Under Kansas state law, for injuries that occur on or after May 15, 2011 an injured worker generally must report the injury to his or her employer within 30 days in order to be eligible to receive workers' compensation benefits. However, this period may be shortened to 20 days under certain circumstances. For injuries that occurred before May 15, 2011, there are different deadlines. Therefore, it is essential to take action quickly if a workplace injury occurs.
After notifying your employer of the injury and your intent to seek workers' compensation benefits, you must get treatment from a health care provider authorized by your employer or its insurance company. This will not necessarily be the same doctor you ordinarily see.
In most cases, your employer's insurance company will work with your attorney to reach a negotiated settlement on your claim. If the negotiation process does not result in a fair settlement, you may present your claim at a hearing before a judge who will issue a ruling.
