TAMPA, FL, July 23, 2012 (Press-News.org) Few things can turn a homeowner's life upside-down more than discovering sinkhole damage. While you ensure your family's safety, arrange the necessary evaluations and handle other obstacles, your insurance carrier can play an essential role in getting your life back to normal. Unfortunately, property insurers are not always helpful.
Among mounting complaints about Florida insurers that fail to pay claims, Tower Hill Select Insurance Company is no exception. The company is appealing a decision that required them to pay for a policyholders' sinkhole damage. In Glen and Kimberly Traving v. Tower Hill, Fifth Circuit Court Judge Frances King ruled that the insurer was responsible for subsurface repair costs. However, rather than a check for repairs, the Trabings got a notice that the decision in their favor was being appealed.
This appeal is not Tower Hill's first attempt to avoid covering the Trabings' sinkhole damage. The insurer spent two years litigating the initial claim, rather than resolving it in a fair way. When they were unsuccessful in court, Tower Hill tried to force the policyholders to begin making repairs before receiving payment. Again, they were defeated in court and ordered to pay the claim.
Tampa insurance litigation attorney Theodore A. Corless is proud to represent the property owners in their ongoing struggle with Tower Hill. With 17 years of legal experience and hundreds of successful trials under his belt, Corless has long been an advocate for victims of sinkhole damage and insurance bad faith.
