August 08, 2012 (Press-News.org) During the 2012 Fourth of July holiday, Georgia drivers may have noticed an increased police presence on the roads as they participated in their summer celebrations. Georgia law enforcement targeted those whom they suspected of drinking and driving during a state-wide program called Operation Zero Tolerance. Georgia drivers should be aware of what Operation Zero Tolerance is about and what to expect if pulled over by police.
"Over the Limit, Under Arrest"
Operation Zero Tolerance is Georgia's contribution to a nationwide campaign to crack down on drinking and driving called "Over the Limit, Under Arrest." As part of Operation Zero Tolerance, sheriffs' deputies, police officers and highway patrol officers band together to run DUI checkpoints and concentrate patrols in areas that have historically high levels of DUI arrests and accidents. Authorities across the state make DUI enforcement a priority during the campaign.
The first phase of Operation Zero Tolerance occurred over the Fourth of July holiday. Georgia authorities report that the program will start up again December 16, 2012 for the winter holiday season.
What Happens During a DUI Stop
When a police officer stops a driver for suspected DUI, the officer will conduct a series of field sobriety tests:
-Horizontal nystagmus test: The officer will ask the driver to follow an object with his or her eyes while the officer looks to see if the driver's eyes are jerky.
-Walk and turn: The officer will tell the driver to walk nine steps heel-to-toe, then turn and walk back in the same manner.
-Balance: The officer will have the driver to balance on one foot.
If the driver cannot perform these tasks to the officer's satisfaction, then the officer will have the driver take a preliminary breath test. If the PBT shows that the driver's blood alcohol concentration is above the legal limit, the officer will arrest the driver.
Talk to a Lawyer
Campaigns like Operation Zero Tolerance show just how seriously Georgia authorities take drinking and driving offenses. The state punishes people for DUI to the fullest extent allowed by law and the penalties can be severe. If you are facing DUI charges, contact an adept criminal defense attorney who can defend your rights through the process.
