Along with social media comes many positives and negatives. Facebook and Twitter provide great ways to stay in touch with loved ones and transmit information in a quick and efficient way. Recently however, social media is having a larger role in divorce proceedings in the United States, and often, the consequences of using social media in this setting are not positive.

How Social Media Can Affect a Divorce Case

The American Academy of Matrimonial Lawyers reports that social media postings are increasingly being used in divorce proceedings. Posts on Facebook may be used for various reasons while a couple is facing divorce. One of these reasons may be to verify what the other party is saying or to bring up information they posted as a tool in the divorce proceedings.

For example, negative posts about one's children or the responsibilities of raising kids may be used as evidence that a parent may not be the best custody provider for the children. Pictures shared of lavish vacations or expensive new cars also may contradict a spouse's claim that he or she cannot afford to make child support or spousal maintenance payments.

Avoiding Pitfalls

The best way to avoid pitfalls with social media and divorce is to keep divorce out of social media postings. When posting on Facebook or Twitter, spouses should bear in mind that these posts may be shared in the courtroom with the judge who is ultimately deciding their divorce case.
