The Surrogacy Lawyer Voices Her Opinion on Colorado's Amendment 62

Surrogacy lawyer Theresa Erickson voices her opposition to Colorado's Amendment 62.In November, the people of Colorado will decide whether or not fertilized human eggs should have full legal rights. Amendment 62 states that "the term 'person' shall apply to every human being from the beginning of the biological development of that human being."
Those who oppose Amendment 62 say that if passed the Amendment could ban all abortions even in cases of rape or incest or to save the woman's life, outlaw birth control other than barrier methods, outlaw IVF procedures, prohibit embryonic stem cell research and criminalize miscarriage. Those in favor of the amendment claim that they are only looking to protect human life from the very beginning of biological development.
"Amendment 62 would impact over 20,000 state and local statutes, complicating property rights, inheritance rights, and more. If this law was passed, the most likely outcome would be a mountain of expensive litigation resulting in it becoming unenforceable," states Attorney Erickson. "Further, Amendment 62 could severely restrict the third party reproduction process in Colorado and could prevent the people that need IVF in Colorado from having a child in Colorado."
In 2008, a similar amendment was defeated 73% to 27% in Colorado. Attorney Erickson explains that the only difference between the 2008 and the 2010 version is that "the 2010 amendment takes the word fertilization out, but it is still a personhood amendment looking to define a person at the moment of conception."
