Raleigh Criminal Lawyer Defends Repeat DWI Offender

March 14, 2011 (Press-News.org) When a North Carolina resident was accused of his second Driving While Under the Influence (DWI) charge in two years, he turned to criminal attorney Patrick Roberts of the Roberts Law Group PLLC. Mr. Roberts was able to rely on his in-depth knowledge of North Carolina DWI law to obtain a more positive result for his client.

Mr. Roberts' client was convicted of his first DWI less than two years ago and this time around, based on all of the facts, his client decided to plead guilty to his second Wake County DWI charge. The plea agreement involved substantial negotiations with the Wake County Assistant District Attorney (ADA) assigned to the case. As a result of Mr. Roberts' negotiations, the DA agreed to probation, rather than prison time. Mr. Roberts' client was actually facing up to two years in prison and, instead, received probation for his repeat DWI offense.

Mr. Roberts' client also received credit for two weeks spent at in-patient care facility that he entered voluntarily. The client's efforts to seek treatment for alcohol abuse were rewarded with credit as a result of North Carolina's law that provides a day-for-day credit for in-patient care.

In evaluating the circumstances of this criminal defense case, Mr. Roberts noted that it is "important, when trying to obtain a result for your client, that you understand the nuances of the law and how you can utilize treatment for someone who is facing a second or third DWI." Repeat DWI offenses are unlike first DWI offenses and should be evaluated differently to maximize those options that are alternatives to jail time, Mr. Roberts said.
