"...We have made the decision to use 'even better technology' that will eventually allow users to search for, download, convert, and push media to the device of your choosing..." FreeFox says it qualifies as 'time-shifting,' the practice of making content viewing more convenient, and therefore protected by the landmark Sony Corp. of America v. Universal City Studios, Inc. ruling, aka the 'Betamax case.'

The new FreeFox software is a revolutionary and powerful online downloading tool which will help end users download videos from YouTube and soon over 100 popular video hosting websites. Additionally, it includes the ability to converter video format to MP3 audio, and soon the most popular audio formats, like wma, aac, ac3, m4a and so on.

FreeFox also supports the ability to download the actual video from YouTube and save them out to whatever device that supports video play back, including FLV, MOV, MP4, PSP, AVI, MPG, and WMV. Additionally, the end user will be able to select the video size up to 1080P HD (1920x1080).

The software is compliant with the fair use "time shifting" provisions of the United States Supreme Court's decision in the case of Sony Corp. of America v. Universal City Studios, Inc., 464 U.S. 417 (1984), (referred to hereafter as the "Betamax Decision"). Time shifting is the recording of programming to a storage medium to be viewed or listened to at a time more convenient to the consumer. Typically, this refers to TV programming but can also refer to broadcasts of radio, video, and other multimedia.

The Betamax Decision ruled that the making of individual copies of complete television shows for purposes of time-shifting does not constitute copyright infringement, but is fair use. Downloading must be for time-shifting, personal, private, non-commercial use only.
