Fatal Day Care Accident Leads to Multiple Lawsuits
Child care injuries are alarmingly common and the harm may result from a variety of sources. However, all day care accidents typically involve employee negligence or recklessness.
NEW YORK, NY, August 01, 2012
Just weeks ago, a day care van filled with children veered wildly toward oncoming traffic before leaving the road and crashing into a tree. The accident injured 15 passengers -- 14 of them children -- and killed a 31-year-old woman.Bystanders who rushed to help the screaming children were horrified to see that many of them had been improperly restrained in seat belts.
"I'm just going to tell the truth -- they had four kids in one seat belt," said James Jaggers, a good citizen who assisted the injured children after witnessing the van crash. Jaggers told Wave3 News in Louisville that he found at least four children lying on the floor of the wrecked vehicle when he arrived.
The day care accident seriously injured several children who required extended hospitalization. One young child remained hospitalized for more than two weeks before finally stabilizing enough to return home. The injured children's parents are demanding answers from Heavenly Angels Childcare Center; four lawsuits have already been filed.
New York Day Care Injuries Far Too Common
While the Heavenly Angels Childcare accident took place in Kentucky, many children in New York are victims of day care negligence, both physically and psychologically.
One father plans to sue a New York day care center after an employee allegedly put his daughter in a closed box. "I'm the father; my job is to protect my daughter," said the man, whose daughter has Asperger's syndrome.
In Rochester, New York, a day care center employee was recently arrested on suspicion of having sexual contact with children younger than 13 and possession of child pornography. The predatory sexual assault allegations have parents throughout the state concerned about the people responsible for their children's care and safety. It's horrific to think that children can be exposed to sexual predators while in day care.
Common child care injuries involve:
- Negligent supervision
- Child neglect
- Child abuse
- Failing to protect against foreseeable dangers
- Inappropriate contact
If your child has been harmed or killed while at day care, you likely have legal recourse through a personal injury or New York wrongful death lawsuit.
