Kansas Court of Appeals Rules Recidivist Law for Sex Offenders Is Too Harsh

The Kansas Court of Appeals recently ruled the imposition of lifetime post-release supervision for a sex offender who committed a low-grade felony is unconstitutional. The court compared the recidivist statutes for sex offenders to the corresponding rules for murderers and found "even murderers are not treated so harshly." With that finding, the court concluded that the lifetime post-release supervision of a young Kansas man violated the Eighth Amendment's protection from cruel and unusual punishment.

Most Indiana drivers have seen someone behind the wheel of a car, holding a cellphone and seemingly oblivious to much of what is going on around them.
