A North Carolina driver facing a DWI charge, four months in prison, a one-year-license suspension and the costs and hassles associated with an ignition interlock device had the drunk driving charges dismissed at a pre-trial hearing. Wilmington DWI defense attorney Ryan Stump persuaded the judge that the State's inability to move forward with the case was reason to drop the DWI charge.In North Carolina v. S.T., our client had allegedly backed into a fence. His actions were observed by police who then stopped him on suspicion of impaired driving. He was subsequently arrested and charged with DWI.
During a pre-trial hearing, the prosecution was unable to provide a witness to prove that police had in fact witnessed our client backing into the fence. Since this was the reason for the stop leading to the DWI charge, the state could not proceed without this witness. The prosecution requested a continuance, essentially postponing the hearing to a later date, but the judge refused to grant it. DWI defense attorney Ryan Stump was able to convince the judge that it would be more appropriate to dismiss the charges against our client than to let the State drag the case out into the future.
