OLD BRIDGE, NJ, November 03, 2012 (Press-News.org) The New Jersey Department of Environmental Protection (NJDEP) put new wastewater regulations in place in early 2012 relating to septic systems, cesspools and septic system inspections for all real property transactions. The new rules and regulations add more structure to an aspect of property sales that received little analysis in years past but with environmental concerns growing, the change is a positive step forward.
Six months into the new regulations, here is a recap of what you need to know:
• Property sales involving septic systems may take longer to close in New Jersey.
• Properties in New Jersey that have a cesspool will be required to replace it with a new septic system installation prior to closing. (except if the property is sold to a family member)
• Shared septic systems are no longer permitted. Prior to the sale, any home that has a shared septic system must be disconnected from the existing septic system and reconnected to a newly installed system.
• The new septic system regulations do not mandate a septic system inspection in NJ; it establishes the protocol for municipalities and inspectors while conduction septic inspections.
• Upon completion of septic inspection in New Jersey, the septic inspectors are required to submit results/findings to the local health department.
• The regulation requires local health department officials to respond to every report of system malfunction. It also calls for the health department to visit the property even if the inspection report concludes the septic system is working properly.
• All other problems uncovered during the septic system inspection are to be resolved by the parties involved in the transaction. The seller and buyer may negotiate who is accountable for the corrections, modifications or upgrades.
