Miami Attorneys File a Lawsuit Against the City of Miami to Stop Illegal Neighborhood Development

MIAMI, FL, February 26, 2013 (Press-News.org) Attorney Philip Freidin of the Miami law firm of Freidin - Dobrinsky has volunteered to represent the citizens of West Grove in their fight to stop the City of Miami and Astor Development Holdings, LLC, from building a trolley garage in their neighborhood. Philip Freidin is helping to give a voice to a group of citizens too long unheard by the City of Miami and has filed a lawsuit to stop the construction of the trolley garage.

When a developer approached the City of Coral Gables about building a luxury condominium complex on the site of the city's existing trolley garage, the city approved the request on condition that the developer find a new home for the garage. The developer found what it felt was a suitable location in a nearby West Grove neighborhood and the City of Miami quickly approved the plans to construct the new garage.

Unfortunately, the new garage offers little, if anything to its new community. The trolley system is a popular option for transportation in Coral Gables but offers no service in the West Grove. Coral Gables cited cost reasons for refusing to add a trolley stop in the Grove neighborhood and Astor refused to incorporate any retail space in its plans that may otherwise have brought jobs to the community.

The garage is an industrial complex that is being built right in the middle of a residential area where children play and families call home. Developers intend to use the garage to store trolley cars overnight, to warm them up in the mornings and as a place to complete necessary repairs. The garage will have operating hours from 5 am to 11 pm in an area surrounded by single-family homes.

Some groups have described the trolley garage as a potential health risk. It puts the men, women and children who call the West Grove home at increased risk of developing lung cancer and other health issues. Diesel exhaust has been categorized as a carcinogen by the World Health Organization, which noted that the fumes from diesel-powered vehicles, like trolley cars, are more toxic than cigarette smoke. In addition, diesel emissions have been shown to make breathing conditions, such as asthma, much worse in children and the elderly.

Many residents of West Grove, a predominantly black and low-income area, felt that they were steamrolled into accepting the trolley garage construction in their neighborhood: their objections were not heard, the impact to their community was not considered and a committed effort to let the public know about the construction plans was not made. Many were not aware of the plans to build in their neighborhood until construction had already begun. Those that were aware were stopped from appealing the City of Miami's approval of the industrial complex by the cost of an appeal and an attorney to represent their interests.
