Johnson & Johnson Paying Doctors to Help Obtain DePuy Hip Recall Victims' Private Medical Records

BEVERLY HILLS, CA, October 25, 2010 (Press-News.org) Hip recall victims allege DePuy Orthopaedics may be encouraging doctors to breach patient-doctor confidentiality protocols through deceptive tactics. In exchange for assistance collecting private medical information on hip replacement recall victims, DePuy is offering doctors a payment of $50 for each medical information packet delivered. Attorneys involved in the DePuy hip recall lawsuit are advising recall victims to NEVER share information with DePuy, Johnson & Johnson, or allow a physician to release medical records to any 3rd party company. Any medical information or explanted medical devices given to DePuy may be used against a hip replacement recall victim as evidence in court.

ASR hip recall information packets sent by DePuy to surgeons include a section outlining tactics on how doctors should persuade patients to sign over private medical records. Another document asked healthcare professionals to hand over any defective hip implant devices removed from a patient's body. Defective ASR hip implants have been found to cause broken bones, joint dislocation, pain, swelling, and even metallic poisoning.

Hip recall lawyer, Larry Nagelberg said, "DePuy recall victims have the right to substantial compensation for pain and suffering. Patient's trust their doctors to provide honest advice. Johnson & Johnson has shown how low they're willing to sink by coercing physicians to violate that trust."

DePuy Orthopaedics, a Johnson & Johnson company, announced a full recall of ASR hip implant systems on August 24, 2010. The hip replacement recall was issued after the National Joint Registry (NJR) released a research report showing alarmingly high rates of DePuy hip implant failure. An estimated 12,000 individuals may require a debilitating hip revision surgery as a result of the hip implant recall.
