CHARLESTON, SC, May 01, 2013 (Press-News.org) Evan Guthrie of the Evan Guthrie Law Firm in Charleston, South Carolina taught a class on the subject of estate planning at Hanahan Senior Center in Hanahan, SC on Thursday February 28th 2013. The class that attorney Evan Guthrie taught went over the basics of estate planning and probate and covered aspects including what an estate is and what makes up and estate, the most common types of assets that one can own, the difference between probate and non-probate assets, how the probate court process interacts with a deceased person's estate, the five main steps of probate in South Carolina, how much probate fees are and how long probate usually lasts, the duties of a personal representative, the most common types of plans that most people use on their estates, what happen when someone dies without a will or other device, how intestate succession works in South Carolina and who gets what, how a simple will works and the main benefits that is bestows, how a living trust works and how it is different than a will, how to fund a trust and what happens when a trust is not properly funded, how to plan for incapacity using a durable power of attorney, how to make advance health care decisions with a healthcare power of attorney or living will, the most frequent mistakes that people make when planning an estate and how to overcome them, and all of the areas that people should focus on when getting started in making a plan.
The Hanahan Senior Center provides activities and educational events for its members to take part in. Mr. Guthrie's class was part of a lunch and learn that allowed those in attendance to eat a meal while learning about how to plan an estate. Attorney Guthrie's presentation lasted about an hour in duration and provided time after for a question and answer sessions. Attendees had many questions including how to potentially disinherit a spouse through a prenuptial agreement to how to plan for an estate with heirs that lived outside of the United States, and if a living trust had value beyond avoiding probate court. Mr. Guthrie enjoyed teaching about estate planning to a great audience and looked forward to coming back at a future date and speaking again.
