Labor Board's Poster Rule Struck Down by D.C. Court of Appeals

GARDEN GROVE, CA, May 10, 2013 (Press-News.org) Labor Law Center, a trusted online source and marketplace for business compliance solutions, announces the U.S. Court of Appeals for the District of Columbia Circuit struck down the National Labor Relations Board's rule requiring millions of employers to conspicuously display the 11x17 inch notice informing workers of their right to form a union. The three-judge panel of the court said that the poster violates employers' free speech rights by compelling them to display the poster or be subject to government citations for failure to comply with the labor law.

"The National Labor Relations Act (NLRA) poster debate has been going on since August 2011 and many businesses are concerned with their compliance because of conflicting information that exists", says Kelly Petersen, Compliance Account Manager at Labor Law Center. "While the NLRA poster debate is still not over, we want businesses to know that the NLRA poster is non-mandatory and will not jeopardize their compliance. We continue to offer the NLRA poster as a separate posting or as an option to include on their combined state and federal poster until a final ruling is made."
