Rottenstein Law Group Contemplates Inconsistent Messages from Zimmer Regarding Recall of NexGen Knee Components

NEW YORK, NY, May 04, 2011 (Press-News.org) The Rottenstein Law Group, which represents clients with claims stemming from the failures of defective knee replacement devices manufactured and sold by Zimmer Holdings, Inc., is trying to make sense of the mixed messages from that company about its NexGen replacement knee.

In 2003, the Zimmer NexGen CR-Flex implant was first introduced as a new solution to knee problems. The product purported to give recipients a broader range of motion than ever before. It has now been used on over 150,000 surgeries and makes Zimmer millions of dollars every year in revenue. However, a recent study has brought to light data that is causing people to second-guess the effectiveness of the NexGen CR-Flex model. The surgeons who conducted the study--including Dr. Richard A. Berger, who for years designed surgical tools and artificial joints for Zimmer--are advocating for the product's removal from the market.

Even while Zimmer is now aggressively trying to quell rumors of a potential recall of the replacement knee devices, the company did quietly recall some 350 components used in NexGen knee replacements because they were found to have "nonconforming and inconsistent geometry." According to reports, Zimmer recalled components of its NexGen Complete Knee Solution LPS-Flex Fixed Knee system in September 15, 2010, by sending a letter to distributors, sales staff, risk managers, and surgeons. Nevertheless, the U.S. Food and Drug Administration did not post notice of the recall until months later, and it appears that neither Zimmer nor the FDA issued a press release announcing the recall.

Unfortunately, recipients of joint replacement units often do not know the manufacturer and/or model of the specific device received. This circumstance can lead to a victim's failing to take required actions--medical and legal--timely. Accordingly, the Rottenstein Law Group is encouraging anyone with a friend or relative who has received a knee replacement device to reach out to that person and recommend that he or she consult a physician immediately and then speak to a qualified personal injury lawyer.
