MIAMI, FL, June 15, 2011 (Press-News.org) John H. "Jack" Hickey and David C. Appleby recently scored a $3 million verdict in a slip and fall case against the Carnival Corporation following a two-day jury trial in U.S. District Court in Miami (Case no: 10-cv-21627). Hickey and Appleby represented Denise Kaba, a mother of four from Jackson, New Jersey who slipped and fell on a slick pool deck surface on the Carnival Pride cruise ship in 2009.
According to the lawsuit, Kaba was on a Caribbean cruise sailing from Baltimore with her husband and slipped when she moved some pool chairs on the Lido Deck. She suffered a fractured knee and underwent six surgeries. Hickey said Kaba now walks with a brace from her hip to her ankle and is in constant pain.
"Doctors said she will need one or two total knee replacements and possibly the knee might have to be fused into one position," added Hickey. "The kneecap fractured so badly it pulled apart. It also fractured in many pieces."
Attorneys claim Carnival failed to maintain the floor and allowed a large area of water to remain on a multicolored surface that is known to be slippery.
U.S. District Judge Ursula Ungaro found the following damages: $1.96 million for future non-economic damages, $595,476 for past and future medical expenses, $200,000 for pain and suffering, $170,500 for loss of earnings capacity and $72,198 for prejudgment interest.
