July 08, 2011 (Press-News.org) Use of Real Estate Divorce Specialists Increasing
In the United States, approximately half of all married couples will end up getting a divorce. Many of these divorces will involve the sale of the family home or the purchase of a new one. While divorce can be emotional, there are specific and practical property issues that must be considered. To help couples through this aspect of the process, an emerging field of real estate agents are specializing in divorce-related property issues.
A real estate divorce specialist is a real estate agent trained to help divorcing or divorced couples get through the process of selling their real estate, usually their marital home and other jointly owned property.
Handling the emotional nature of property issues in divorce is a large part of their training, as divorcing couples may have difficulty deciding on a sale price, disagree on the anticipated equity and be unable to agree on showings. This can all be further complicated if the divorce is contentious. Real estate divorce specialists also work to educate couples about the financial and legal aspects of the real estate process. Their job is not to take sides, but to focus on the property issues and show the divorcing couple that they do have options.
Real estate divorce specialists stress they are only one part of the process. Other professionals are necessary to effectively represent each divorcing spouses' interests, as issues like spousal support, complex property division, child custody and visitation all require a family law attorney.
These agent specialists supplement the advice of attorneys, financial advisors and others that commonly work with divorcing couples. All the professionals are needed to make sure the final outcome of the divorce and the sale of the home will be fair to everyone involved.
Contacting an Attorney Is the First Step
Finding an experienced family law lawyer should be the first step for those who are considering divorce. An attorney can help identify all the issues that may come up and develop a strategy to make sure that his or her client's interests are protected.
