Family Attorney Investigates the "Gray Divorce" Trend

Family attorney John Griffith investigates the divorce trend affecting baby boomer couples that has been termed "gray" divorce.

2012-07-02
SAN DIEGO, CA, July 02, 2012 (Press-News.org) In 2009, a study showed that persons above the age of 50 accounted for more than one in four divorces.

Has the dream of "growing old together" become passe or can it still be accomplished?

Drs. Susan Brown and I-Fen Lin conducted the study called "The Gray Divorce Revolution," asserting that the rising percentage of divorce among older couples is linked to economic shifts, couples' relationship histories and the change in the stance on divorce in America.

The term "gray" divorce is used to describe divorces involving people who are 50 years or older.

"It's exciting knowing there is research out there to expound on this new trend,"said divorce lawyer of San Diego, John Griffith of Griffith & Young, APC. "San Diego law offices, and law offices all over the U.S. are seeing an influx of older clients requesting legal separation or divorce.

More women work, earn income and have the option to provide for themselves rather than remain in a marriage they no longer wish to be part of.

A recent AARP study confirmed that approximately 67 percent of older-adult divorces are filed by women.

According to Brown's interview in NPR's "Talk of the Nation," the relationship history of a spouse is the most prevalent cause in "gray" divorces.

"Over the years, it is more probable that a client will divorce if they have divorced once before," said Griffith, a family attorney in San Diego and provider of family court services.

Brown's research realized that roughly half of the divorces among those 50 years old and older were in remarriages.

Brown mentioned in her interview with NPR that the '70s generated a new trend in marriage. It brought about the question, "Is a partner satisfying the personal needs of their spouse?"

With the rise in acceptance of divorce, it is the new answer to supplying individual contentment among unhappily married baby boomer couples.

Sociologists anticpate the "gray" divorce trend will continually grow. The notion of "growing old together" surely will fade as "gray" divorce rates rise, Griffith said as a child support lawyer in San Diego.
