BOHEMIA, NY, January 22, 2013 (Press-News.org) The New Year is here in full swing, but for many business owners and executives, some part of the old year may be holding them back, according to attorney Steven Taitz, a partner with Roe Taroff Taitz and Portman, a Long Island Law Firm. "Clients often come to us at the beginning of the year with their New Year's resolutions as well as concerns about legal issues and disputes they have been unable to resolve at the end of the previous year," says Taitz. He has developed a list of the Four Ways to Know it's Time to Call a Lawyer to let other business owners and executives identify whether it might be time for them to seek professional counsel and guidance.
Four Ways to Know it's Time to Call a Lawyer
Taitz suggests that there are four ways to identify whether it's time to pick up the phone and call a lawyer:
1. A New Year's resolution to get your affairs in order. Whether you believe Congress spared us from the fiscal cliff or not, 2013 is now upon us. We now know what the changes are regarding capital gains tax, income tax and estate tax so we can plan accordingly. Gift tax exemptions are now up to $14,000, so it may be the right time to plan tax related gifting for the coming year.
2. There's a big purchase on the horizon. If a company or individual anticipates a large transaction - for example, purchasing a new building, acquiring a business or business assets, or a large capital expenditure, such as a new fleet of trucks - it is very important to check with an attorney to review the terms of the transaction, so that you know exactly what you are getting yourself into as well as seek any advice regarding tax implications.
3. That dispute from last year refuses to resolve by itself. Whatever the issue is, if it hasn't resolved itself by now it may mean it's time to take things to the next level. It's at those times that an attorney can offer perspective, guidance and support for moving forward to a resolution between the parties.
4. Someone big leaves the company. People come and go in business - it's a fact of life. But when you run a business and a partner, large territory or named accounts sales person leaves, there may be concerns about poaching clients and competing by using trade secrets. Then it's good practice to ask an attorney to review existing employee and client contracts to ensure all parties are following their agreements.
"People tend to wait until the last minute," says Taitz. "But it is usually easy to spot areas where an attorney's involvement can help move a difficult issue along."
